SECOND APPEAL No.163 of 2021
JUDGMENT :
The appellant had preferred this Second Appeal, aggrieved of the dismissal of A.S.No.10 of 2018 by judgment dated 21.06.2021, passed by the II-Additional District and Sessions Judge (FTC), FAC IX Additional District & Sessions Judge, Medak at Sangareddy, confirming the judgment and decree dated 29.12.2017, passed by the Senior Civil Judge, Sangareddy, in O.S.No.296 of 2011.
2. Heard.
3. The suit for recovery of possession of suit schedule shops and for recovery of arrears of rent, filed by the respondent herein, was decreed by the trial Court on merits. Aggrieved of it, the appellant/defendant has filed A.S.No.10 of 2018 before the II-Additional District and Sessions Judge (FTC), FAC IX Additional District & Sessions Judge, Medak at Sangareddy. The said appeal is dismissed, confirming the judgment and decree of the trial Court in O.S.No.296 of 2011.
4. A perusal of the grounds of appeal does not disclose any questions of law, much less the substantial questions of law for entertaining this second appeal. Both the Courts below have given 2 concurrent findings on merits, after trial. In view of the same, this Court is not inclined to interfere with the matter.
5. The Second Appeal is devoid of merit and it is accordingly dismissed at the stage of admission. However, Six months' time from today is given to the appellant for vacating the subject property. Accordingly, the appellant shall vacate the property and give vacant possession to the respondent/plaintiff by or before 06.03.2022. It is made clear that no further extension shall be granted beyond 06.03.2022. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
