ORDER:

1. The present writ petition is filed with the following relief:

"For the reasons stated in the accompanying affidavit it is humbly prayed that this Hon'ble Court may be pleased to issue a suitable writ, order or direction more particularly one in the nature of Writ of Mandamus, for refusing to give benefit of Ordinance 4 of 2020 Dt:31-07-2020 to the Petitioners on the ground that the benefit of Ordinance 4 of 2020 Dt:31-07-2020 to the Petitioners on the ground that the ordinance has no retrospective affect as illegal, arbitrary, discriminatory and violation of article 14 and 16 of constitution of India and consequently, direct the respondents to re-induct the petitioner into service forthwith with all consequential benefits from the date of attaining 58 years and continue them in service until they attain the age of superannuation i.e. 65 years and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

2. Heard the learned counsel for the parties.

3. With the consent of both the parties, without going into merits, this writ petition is disposed of along with the pending applications, if any, directing the respondents to consider the case of the petitioners in the light of the judgment of Apex Court in Civil Appeal No.4578 of 2021, dated 03.08.2021, and take a decision in accordance with law, as expeditiously as possible. There shall be no order as to costs.
