ORDER:
Learned counsel for the petitioner seeks permission to withdraw this writ petition with liberty to the petitioner to prefer an appeal.
2. Permission is accorded and the Writ Petition is accordingly dismissed as withdrawn giving liberty to the petitioner to prefer an appeal in accordance with the Rules. It is needless to say that if the petitioner prefers an appeal, the appellate authority shall consider the same taking into consideration of the judgment dated 03.09.2021 rendered by the Hon'ble Supreme Court in Civil Appeal No.5121 of 2021 (The Assistant Commissioner of State Tax and others Vs. M/s. Commercial Steel Limited) and pass appropriate orders within a reasonable period of time, preferably within eight weeks from the date of filing the appeal. No costs.
3. Pending miscellaneous petitions, if any, shall stand closed.
