JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The appellant before this Court has filed this writ
appeal being aggrieved by the order dated 17.08.2021
passed in I.A.No.1 of 2021 and I.A.No.1 of 2020 in
W.P.No.1074 of 2018.
Learned counsel for the appellant has argued before
this Court that the writ petition i.e., W.P.No.1074 of 2018
was preferred alleging unauthorised construction by the
respondent No.6 over the land which is the subject
matter of the writ petition and the learned Single Judge has granted an interim order of status quo on 02.11.2020. It has been further stated that an application for vacating the interim order was preferred in the matter by the respondent No.6. He has further stated that during the pendency of the writ petition, the respondent No.6 started the construction activity and the learned Single Judge has vacated the interim order, which was passed against the respondent No.6 only because the respondent No.6 was constructing on the land in question.

Learned counsel for the respondent No.6, in open Court, stated before this Court that they have stopped all the construction activities and they shall not be carrying out any construction activity till the matter is decided finally by the learned Single Judge.
In the light of the aforesaid undertaking, the interim order, which was granted earlier, is continued and the learned Single Judge is requested to decide the matter finally at an early date, preferably, within a period of three months from today.
With the aforesaid, the writ appeal stands disposed of. The miscellaneous applications pending in this appeal, if any, shall stand closed. There shall be no order as to costs.
