CRIMINAL PETITION NO.7685 OF 2021
ORDER:
This Criminal Petition is filed by the petitioner/accused seeking relaxation of the conditions imposed by the Metropolitan Sessions Judge, Cyberabad, Ranga Reddy District at L.B. Nagar, in Crl.M.P.No.121 of 2021 dated 22.01.2021 in connection with Crime No.1003 of 2020 of P.S. Uppal.
Heard the learned counsel for the petitioner/accused, the learned Assistant Public Prosecutor representing the respondent- State and perused the record.
The operative portion of the order dated 22.01.2021 passed by the Metropolitan Sessions Judge, Cyberabad, Ranga Reddy District at L.B. Nagar, in Crl.M.P.No.121 of 2021 reads as under:
"In the result, this petition is allowed. The Petitioner/Accused is ordered to be released on bail, on her executing bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two local sureties each for a like sum to the satisfaction of learned III Metropolitan Magistrate, Cyberabad at L.B. Nagar and out of two sureties the Petitioner shall furnish one local surety from her native village. The Petitioner/Accused shall submit her Aadhar Card and the Aadhar Card of her parents and her residential address proof certified by the Village Sarpanch or any Village Assistant with regard to the address of Petitioner/Accused. The Petitioner/Accused shall not leave the State without prior permission from the Court and shall cooperate with the investigating agency. The Petitioner/Accused shall appear before the concerned SHO on first Sunday of every month between 9.00 AM to 4.00 PM for a period of six (06) months or till filing of charge sheet, whichever is earlier. The Petitioner shall also furnish her bank particulars and bank particulars of her parents and if she got any agricultural lands the documents pertaining to the agricultural land shall be furnished."
Having regard to the facts and circumstances of the case, this Court observes as follows:
The petitioner shall execute personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties for the 2 like sum each to the satisfaction of the III Metropolitan Magistrate, Cyberabad at L.B. Nagar and out of two sureties, she shall furnish one surety from her native place. The petitioner shall submit Aadhar Cards, Electoral Cards, Ration Cards and bank particulars together with address and permanent abode of herself and the two sureties respectively. The other condition is modified to the extent that the petitioner shall personally appear before the Court concerned on the date of framing of charges, if any, under Section 240 Cr.P.C., subsequently on each date of hearing, on the date of recording the statements of the witnesses and for her examination under Section 313 Cr.P.C. and also on the date of judgment without fail. However, the other condition regarding the appearance of the petitioner before the Station House Officer shall remain unaltered. However, with regard to the bank particulars and the documents relating to the agricultural land, the petitioner shall furnish an affidavit with regard to the present status of her parents through her brother till she is released and thereafter, she will furnish the affidavit on her own within fifteen days from the date of her release.
Accordingly, the Criminal Petition is disposed of. Miscellaneous applications, if any, pending shall stand closed.
