The learned counsel for both the parties are present.

On a perusal of the record, it is found that O.S.No.133 of 1997 was filed by the appellant/plaintiff on the file of the learned II Additional Chief Judge, City Civil Court at Hyderabad, for perpetual injunction and that the same was dismissed. Aggrieved thereby, the appellant/plaintiff has preferred this appeal.
3. Today, learned counsel of the appellant represents across the Bench that the matter has become infructuous.
4. While recording the representation of the learned counsel for the appellant, the appeal is dismissed as infructuous. No costs. Consequently, Miscellaneous Petitions, pending if any, stand disposed of as infructuous.
