Telangana High Court
Smt. Dodda Rama Devi vs The State Of Telangana And 9 Others on 20 October, 2021
Bench: A.Abhishek Reddy
THE HON'BLE SRI JUSTICE A.ABHISHEK REDDY

WRIT PETITION No. 25682 of 2021
ORDER:

In this writ petition, the petitioner seeks to set aside the impugned order, dated 07.02.2021 in Old Case No. B/1890/2017 (New Case No. F2/Spl.Tribunal/0851/ 2021) passed by respondent Nos. 2 and 3 and seeks a consequential direction to the respondent Nos. 3 and 4 to issue Pattadar Pass Books and Title Deeds in favour of the petitioner by canceling the Pattadar Pass Books issued in favour of respondent Nos. 7 & 8 in respect of 1/4th share of the petitioner in the land in Sy. No. 56/AA, situated at Kalwakutla Village, Munigode Mandal, Nalgonda District.

Even though several grounds have been raised by the petitioner, having regard to the fact that the petitioner has already filed civil suit being O.S. No. 150 of 2016 seeking partition and separate possession of the property, on the file of the Junior Civil Judge at Nalgonda, this Court is not inclined to grant any relief, as sought for in the present writ petition. Ultimately, if the petitioner succeeds in the suit filed by her, the decree is not only binding on the parties but also the revenue authorities and they are bound to implement the Judgment and Decree of the Court.

2

The writ petition fails and the same is accordingly dismissed. It is needless to observe that the Junior Civil Judge at Nalgonda has to decide the suit on its own merits and uninfluenced by the orders passed by the Special Tribunal or the entries made in the revenue records.

Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
