JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present appeal is arising out of the order dated
06.09.2021
passed in I.A.No.758 of 2021 in O.S.No.158 of 2021.
Learned counsel for the appellants has argued before this court that an ex parte interim order has been passed on an application preferred under Order XXXIX Rules 1 and 2 read with Section 151 of CPC and has raised various grounds.
Learned counsel for the parties have fairly stated before this court that as it is an ex parte interim order, they shall be arguing the matter before the trial court and some time limit be fixed for deciding the injunction application preferred under Order XXXIX Rules 1 and 2 CPC.
Resultantly, without adverting to the merits of the case, the trial court is requested to decide the application, after hearing both the parties, within a period of thirty days from today. The parties shall appear before the trial court on 25.10.2021.
With the aforesaid, the appeal stands disposed of. The miscellaneous applications pending in this writ appeal, if any, shall stand closed.
