Bench: Satish Chandra Sharma, A.Rajasheker Reddy
THE HON'BLE THE CHIEF JUSTICE SATISH CHANDRA SHARMA
                                    AND
THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY

                WRIT APPEAL No.518 of 2021

JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)

The present writ appeal is arising out of an order

passed by the learned Single Judge dated 27.07.2021

by which only notice has been issued and no interim

relief has been granted.

Learned counsel for the appellant has argued

before this Court that the appellants are in possession

of the property, which is subject matter of the dispute

and after thirty (30) years, entries in the revenue

records were sought to be modified. Under those

circumstances, the writ petition was preferred.

However, no interim order has been passed. He has

stated that the respondents are likely to alienate the

property and therefore, interim order be granted in favour of the appellant.

Learned counsel for the respondent No.6 has vehemently opposed the interim order. However, she fairly stated before this Court that the respondent No.6 shall not alienate the property and the matter be posted before the learned Single Judge and the learned Single Judge be free to pass appropriate orders on the question of grant of interim relief in accordance with law.

Without adverting to the merits of the appeal, the learned Single Judge is requested to pass appropriate orders on the question of grant of interim relief within a period of thirty (30) days and till such date, the respondent No.6 shall not alienate the property in question.

The writ appeal is disposed of. Office is directed to list the matter before the learned Single Judge on 22.11.2021.
