WRIT PETITION No. 25513 of 2021
ORDER:
In this writ petition, the petitioners seek a direction to the respondents to consider the representations dated 03.06.2021 submitted by the petitioners requesting them not to issue Pattadar Pass Books, Title Deeds and Rythu Bandu amounts in favour of third parties in respect of the land admeasuring Ac.37-01 guntas in Sy. No. 484/AE, 476, 473, 472, 477, 479, 227 and 505, situated at Jaklair Village, Makthal Mandal, Narayanapet District and also in respect of land in Sy. No.46/A and 47/A, situated at Katerpalli Village of Makthal Mandal, Narayanapet District pending the suit in O.S. No. 7 of 2018 on the file of II Additional District Judge, Mahabubnagar.
Even though several grounds have been raised by the petitioners, having regard to the fact that the petitioners has already filed civil suit being O.S. No. 7 of 2018 seeking preliminary decree for partition of the suit schedule property into seven equal shares and allotment of 4/7th share to the petitioners by metes and bounds etc., on the file of II Additional District Judge at Mahabubnagar, this Court is not inclined to grant any relief, as sought for in the present writ petition. The 2 mutation entries do not confer any title on the person in whose name entries are made. Ultimately, if the petitioners succeed in the suit filed by them, the decree is not only binding on the parties but also the revenue authorities and they are bound to implement the Judgment and Decree of the Court.
The writ petition fails and the same is accordingly dismissed. However, if the petitioners are so advised, they can file an appropriate application seeking appropriate relief before the trial Court in the pending suit.
Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
