JUDGMENT:

The present Transfer Appeal Suit is filed by the appellant/1st defendant against the judgment and decree, dated 30.06.2003, passed in O.S.No.122 of 1995 on the file of the Principal Senior Civil Judge, Ranga Reddy District at N.T.R. Nagar, Hyderabad, wherein and whereby the suit filed by the 1st respondent/plaintiff for specific performance of contract of sale, dated 13.04.1994, in respect of land admeasuring 600 square yards forming part of 1280 square yards in Plot No.9 in Sy.No.129/1 of Kothapet Village, Uppal Mandal, Rangareddy District, was decreed.

Initially, the appellant filed A.S.No.129 of 2006 before the I- Additional District Judge, Ranga Reddy District. As the 2nd defendant in the suit filed A.S.No.1903 of 2003 before this Court, the appellant herein filed Transfer C.M.P.No.131 of 2016 before this Court, seeking transfer of the said appeal to this Court to be heard along with A.S.No.1903 of 2003. By an order, dated 12.04.2016, this Court, passed an order withdrawing A.S.No.129 of 2006 from the file of the I-Additional District Judge, Ranga Reddy and transferred the same to this Court to be heard along with A.S.No.1903 of 2003. The said matter was numbered as Tr.A.S.No.114 of 2017.

On 10.02.2021, learned Counsel for the appellant herein would submit that he intends to not press this appeal as the appellant 2 GSD, J Tr.as_114_2017 herein, who is the 2nd respondent in A.S.No.1903 of 2003, has filed vakalat in A.S.No.1903 of 2003 and the said vakalat was accepted, permitting the appellant herein to contest A.S.No.1903 of 2003.

Recording the aforesaid submission, the Transfer Appeal Suit is dismissed as not pressed.

Consequently, miscellaneous petitions, if any, pending shall stand closed. There shall be no order as to costs.
