WRIT PETITION No. 28924 of 2021
ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue for the official respondents. With their consent, the Writ Petition is disposed of at the stage of admission.
This writ petition is filed by the petitioner challenging the action of the respondent No. 4 in trying to dispossess the petitioner from the land to an extent of Ac.2-10 guntas in Sy. No. 688/4/A, situated at Bellal Village Sivar, Kadam Mandal, Nirmal District, under the guise of issuance of Form-I Notice vide proceedings No. B/187/2021, dated 30.10.2021.
Having regard to the fact that the petitioner has already submitted an explanation to the impugned proceedings dated 30.10.2021, without going into the merits or demerits of the case, the Writ Petition is disposed of directing the official respondents to pass appropriate orders, strictly on merits and in accordance with law, as expeditiously as possible, preferably, within a period of four weeks from the date of receipt of a copy of this order, if not already passed, duly putting the petitioner on notice, by fixing a date for hearing. It is needless to mention that the official respondents, before passing any orders, shall take into consideration the judgment and decree, dated 09.03.2021 passed in O.S. No. 60 of 2020 on the file of Principal Junior Civil Judge at Nirmal as well as the copies of pahanis issued in favour of the petitioner. A copy of the order to be passed shall be communicated to the petitioner. Till such time the final orders are passed, the official respondents shall not take any coercive steps against the petitioner. 2
The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
