JUDGMENT:    (Per the Hon'ble the Chief Justice Satish Chandra Sharma)


     The present writ appeal is arising out of the order

dated 02.01.2019 passed by the learned Single Judge in

W.P.No.48117 of 2018.

     The facts of the case reveal that options were invited

from the employees for transfer on completion of eight

years   of   service      and      the     appellant/writ            petitioner

submitted options to as many as 300 posts.                                He was

transferred to one of the place of his choice. However, he

again submitted an appeal for transferring to some other

place, which was rejected on 08.07.2018.                                 The writ

petition was preferred challenging the said proceedings,

which was dismissed by the learned Single Judge.

     In the considered opinion of this Court, as the

employee was transferred as per his option, the question

of interference by this Court with the order dated

08.07.2018

and the order passed by the learned Single Judge does not arise. However, as and when fresh counselling is held, the employee shall certainly be free to submit fresh application for his transfer keeping in view the guidelines issued by the State Government. 2

The writ appeal stands disposed of accordingly. The miscellaneous applications pending in this writ appeal, if any, shall stand closed. There shall be no order as to costs.
