WRIT APPEAL No.752 of 2019
JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of the order
dated 25.07.2019 passed by the learned Single Judge in
I.A.No.1 of 2019 in W.P.No.9573 of 2019.
The order passed by the learned Single Judge
reveals that a civil suit is also pending between the
parties and the respondents have constructed buildings
over the property in respect of which a dispute was raised in the writ petition. This Court does not find reason to interfere with the order of the learned Single Judge rejecting the prayer for grant of interim relief.
However, a request is made to the learned Single Judge to decide the main writ petition at an early date.
Office is directed to list the writ petition before the learned Single Judge having roster on 20.12.2021, on which date the parties shall appear before the learned Single Judge.
It is needless to mention that this Court has not expressed any opinion on the merits of the case and the learned Single Judge shall be free to decide the matter 2 without being influenced by the observations made in the matter.
The writ appeal stands disposed of accordingly. The miscellaneous applications pending this writ appeal, if any, shall stand closed. There shall be no order as to costs.
