CITY CIVIL COURT APPEAL No.39 of 2002
JUDGMENT:
The present appeal arises out of dismissal of suit for partition. It is seen from the record that the appeal against respondent Nos.1 and 3 was dismissed. The appellants have not taken any steps to set aside the dismissal order.
When the matter was taken up for hearing on 29.10.2021, none appeared for the appellants, and hence, the matter was directed to be posted today under the caption 'for dismissal. In spite of posting the matter today under the caption 'for dismissal', there is no representation for the appellants.
Therefore, the City Civil Court Appeal is dismissed for non-prosecution. There shall be no order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
