COMMON JUDGMENT:: ( per Hon'ble Sri Justice Satish Chandra Sharma, CJ)
These writ appeals arise out of the order dated 01-10-2019 passed in
IA No.1 of 2019 in WP No.15488 of 2019 by the learned single Judge
whereby the learned single Judge while allowing the said IA has directed
restoration of the possession of the subject land to the writ petitioners-
respondents herein.
The Division Bench of this Court while entertaining the writ appeals, vide order dated 10-10-2019 granted interim suspension of the impugned order and the interim order is in existence. Now, on account of the interim order passed by the Division Bench, and a vacate petition, IA No.4 of 2019 is filed by the writ petitioners-respondents. In the considered opinion of this Court, the matter has to be decided on merits and, therefore, the learned single Judge is requested to decide the matter at an early date preferably within a period of 60 days from today. The parties shall move an application before the Bench having roster to fix a date and the Office is directed to list the same on 06-12-2021. Till the matter is decided finally, the interim order granted by the Division Bench shall continue.
With the aforesaid directions and with the consent of both the parties, the writ appeals are disposed of. Miscellaneous applications, if any pending, stand disposed of. There shall no order as to costs.
