JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
Learned counsel for the appellants is fair enough in
stating that the learned Single Judge has decided the
writ petition taking into account the order passed in
W.P.No.18299 of 2005 dated 05.09.2005, in which under
similar circumstances the punishment of stoppage of
increment has been modified. He has stated that to the
extent the punishment has been modified, he is not
having any grievance. However, the respondent is not
entitled for any monetary benefits keeping in view the order passed in identical cases.
Learned counsel for the respondent is also fair enough in making a statement that in the identical writ petition, no monetary benefits were granted and therefore, the order passed by the learned Single Judge be modified accordingly.
Resultantly, after hearing and with the consent of the parties, the matter stands disposed of. The respondent will not be entitled for monetary benefits flowing from the order passed by the learned Single Judge.

The writ appeal is disposed of accordingly. The miscellaneous applications pending in this writ appeal, if any, shall stand closed. There shall be no order as to costs.
