It is submitted by the learned counsel for the appellant that the sole appellant, who was the sole dependent of the deceased, has also passed away and therefore, no party is seeking relief from this appeal and that the present appeal may be closed as infructuous.
Accordingly, the Civil Miscellaneous Appeal is dismissed as infructuous. No order as to costs. Miscellaneous petitions, if any, pending in this appeal shall stand closed.
