JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of order dated
31.10.2018 passed in W.P.M.P.No.38004 of 2017 in W.P.No.30491
of 2017 by the learned Single Judge directing the respondents
therein to continue the writ petitioners in service.
The matter has not been adjudicated on merits at all and the writ petitioners/respondents in the writ appeal are health workers and are serving in Bharat Heavy Electricals Limited.
In the considered opinion of this Court, the matter has to be decided on merits and therefore, without averting to the merits of the case, the matter is remanded back to the learned Single Judge with a request to decide the matter as expeditiously as possible within a period of 90 days from today. The parties shall appear before the learned Single Judge on 06.12.2021.
With the aforesaid, the writ appeal stands disposed of. Miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
