JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of the interim order
dated 11.06.2020 passed by the learned Single Judge in
W.P.No.8053 of 2020.
The undisputed facts of the case reveal that the writ petition
came up before this court stating that a survey has already been
carried out in respect of the land, which was the subject matter of
the writ petition, and when based upon the survey, which was
already carried out at the behest of the writ petitioners/appellants,
entries were to be corrected in the revenue records, a second
survey was ordered at the behest of respondent Nos.8 and 9. The
learned Single Judge, while issuing notice, has simply observed that the second survey may go on but the respondents shall not act upon the said survey report until further orders.
This court does not find any reason to interfere with the interim order passed by the learned Single Judge. All the contentions raised in the present appeal are left open, as the writ petition is yet to be decided on merits by the learned Single Judge.
Resultantly, the present writ appeal stands disposed of, without interfering with the interim order passed by the learned Single Judge, with a liberty to the parties to argue the matter on merits before the learned Single Judge. Office is directed to list W.P.No.8053 of 2020 before the learned Single Judge on 06.12.2021.
