JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of an order
dated 13.04.2018 passed by the learned Single Judge in
I.A.No.1 of 2018 in W.P.No.10992 of 2018.
The undisputed facts of the case reveal that the writ
petition was preferred by Smt. Sama Lakshmamma and
others stating that the State Government and the
Hyderabad Metropolitan Water Supply and Sewerage
Board are taking possession of their land without
following the provisions as contained under the Right to
Fair Compensation and Transparency in Land
Acquisition, Rehabilitation and Resettlement Act, 2013.
An interim order has been passed by the learned Single
Judge directing the respondents therein not to interfere
with the peaceful possession without following due process of law under the statute.
The present writ appeal has been filed against the aforesaid order by certain persons claiming right over the same land.
In the considered opinion of this Court, in case the appellants are claiming right in respect of the aforesaid 2 land, which is the subject matter of W.P.No.10992 of 2018, they shall certainly be free to file an application for impleadment before the learned Single Judge.
Resultantly, this Court does not find any reason to interfere with the order passed by the learned Single Judge.
The writ appeal is accordingly dismissed. The miscellaneous applications pending in this writ appeal, if any, shall stand closed. There shall be no order as to costs.
