JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of the order dated
08.09.2021 passed by the learned Single Judge in W.P.No.19939 of
2020.
The undisputed facts of the case reveal that the present
appellant/writ petitioner has filed a writ petition for issuance of a
writ, order or direction to the State Bank of India to regularise his
loan account. It was stated by the appellant/writ petitioner that
he obtained a loan of Rs.3,00,000/- from the State Bank of India
and he was not able to pay regular instalments. It was further
stated that he was willing to pay the entire loan amount and he
wanted the loan account to be closed.
Learned counsel appearing for the writ petitioner contended
before the learned Single Judge that appropriate order be passed
directing the respondent to consider the case of the appellant/writ
petitioner for re-structuring the loan and to enable him to clear the entire loan amount in accordance with Rules. As a prayer was made by the appellant/writ petitioner himself before the learned Single Judge, the learned Single Judge disposed of the writ petition with a liberty to the appellant/writ petitioner to submit a detailed representation and the Bank has been directed to decide the same in accordance with law. Meaning thereby, the prayer of the appellant/writ petitioner has been accepted by the learned Single Judge. Therefore, this Court does not find any reason to interfere with the order passed by the learned Single Judge. 2
Admission is declined. The writ appeal stands dismissed. Pending miscellaneous applications, if any, shall stand closed.
