Criminal Appeal No.939 of 2008
JUDGMENT:
This Criminal Appeal is filed by the appellant/complainant under Section 378(4) Cr.P.C, challenging the judgment dated 08.04.2008 passed in C.C.No.2143 of 2005 by the learned X Metropolitan Magistrate, Cyberabad, at Malkajgiri, wherein the Court below acquitted the respondent Nos.1 to 3/Accused Nos.1 to 3 for the offence punishable under Section 138 r/w 142 of N.I. Act.
2. Heard the learned Assistant Public Prosecutor appearing for respondent No.2-State and perused the record.
3. No representation for the appellant. On earlier occasion also, there was no representation for the appellant and hence, the matter was posted "for orders" today. Even then there is no representation for the appellant. It appears that the appellant has no interest to pursue the matter.
4. Under these circumstances, this Criminal Appeal is dismissed for default.
Miscellaneous petitions, if any, pending in this Criminal Appeal, shall stand closed.
