SECOND APPEAL NO.829 OF 2013
JUDGMENT:
1. Counsel for the appellant stated that both the appellant and respondent died and he also got instructions that both the parties have executed a registered sale deed in favour of the third parties in respect of the suit schedule property. The suit was filed for partition of the suit schedule property as they have jointly purchased the said property.
2. In the light of the said submission, the Appeal is dismissed as abated. No order as to costs. As a sequel, the miscellaneous petitions pending if any shall stand closed.
