JUDGMENT:
The present appeal is arising out of a bankers money suit and the appeal is filed by the second defendant.
2. There is no representation from the appellant inspite of the case being posted under the caption for dismissal.
3. In the said circumstances, the appeal is dismissal for non prosecution. No order as to costs. Any stay granted earlier, shall stand vacated and the other miscellaneous petitions pending if any shall stand closed.
