APPEAL SUIT NO.688 OF 2000
JUDGMENT:
This Court by order dated 21.10.2021 allowed I.A.No.1 of 2021 which was filed to condone the delay of 7047 days and to set aside the abetment on payment of costs of Rs.5,000/- towards Legal Aid Fund of the High Court Legal Services Committee and proof to that effect shall be filed by 27.10.2021 and the said application was filed by the legal heirs of the respondent in the appeal.
2. Thereafter, the matter was lilted on 28.10.2021 and this Court suo-motu extended time to pay the costs and the matter is posted today under the caption for dismissal. There is no representation from both the counsel and costs have not been paid even in the extended time also. As a sequence, the petitions filed to bring the legal representatives by condoning the delay and by setting aside the abatement stands dismissed and the appeal stands abated against the respondent.
3. Accordingly, the Appeal is dismissed as abated. No order as to costs. As a sequel, the miscellaneous petitions pending if any shall stand closed.
