       Heard    Mr.    S.Chakrapani,      learned   counsel   representing

Mr.Challa Gunaranjan, learned counsel for the appellant and

Mrs.Mamatha, learned Senior Standing Counsel for the Income Tax

Department for the respondent.

2. Learned counsel for the appellant submits that appellant has opted for settlement under Vivad Se Vishwas scheme. Therefore, in terms of the scheme, he is required to withdraw the appeal. Hence, the prayer for withdrawal of the appeal.

3. We grant liberty to the appellant to withdraw the appeal so as to pursue the remedy under the Vivad Se Vishwas scheme.

4. The appeal is, accordingly, disposed of.

5. No costs.
