JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)
1. Learned counsel for the appellant fairly states that instead of
pressing the present appeal that is directed against an order dated
22.08.2019 passed by the learned Single Judge dismissing
W.P.No.21854 of 2001 wherein, the appellant/company had
challenged an order dated 31.12.1999 passed by the respondent No.2
that had been confirmed by an order dated 04.09.2001 passed by the respondent No.1, the appellant/company is willing to pay the balance awarded amount to the respondent No.3/workman and seeks leave to withdraw the present appeal, while reserving its right to seek appropriate legal recourse in similar facts and circumstances, if need so arises in future.
2. Leave, as prayed for, is granted. The present appeal is disposed of as not pressed along with the pending applications, if any. The balance payment shall be tendered to the respondent No.3/workman within two weeks from today.
