THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO
AND
THE HONOURABLE SRI JUSTICE T. VINOD KUMAR
I.A.No.3 of 2021
in/and
C.M.A.No.100 of 2021
JUDGMENT: (Per Hon'ble Sri Justice M.S. Ramachandra Rao)
Heard Sri E.Madan Mohan Rao, leaned counsel for appellants
and Sri V.Srinivas, learned counsel for respondent.
2. Sri V.Srinivas, learned counsel for respondent has placed a detailed docket order dt.10-02-2021, which indicated that reasons have been given by the Court below while granting ad interim injunction ex parte on 10-02-2021 in I.A.No.73 of 2021 in O.S.No.68 of 2021.
3. In view of the same, and since we had earlier granted interim suspension on the basis of a decretal order dt.10-02-2021, without having knowledge of the reasoned order passed by the Court below on 10-02-2021, we vacate the order dt.19-02-2021 in I.A.No.2 of 2021 in C.M.A.No.100 of 2021. Accordingly, I.A.No.3 of 2021 is allowed.
4. Since it is now stated that even appellants have filed counter- affidavits in I.A.No.73 of 2021 in O.S.No.68 of 2021, the Court below is directed to hear both sides and decide the said I.A. within six (06) weeks.
