I.A.No. 1 of 2020 in/and APPEAL SUIT No. 1236 of 2018 COMMON JUDGMENT:
I.A.No.1 of 2020 is filed under Order XXIII Rule 1 CPC with a prayer to record the compromise in terms of memorandum of compromise and dispose of the appeal in terms thereof.
Today, when the matter is taken up, the parties are present in the Court and have produced their respective identity proofs. They are all identified personally by the learned counsel appearing for them. They have stated before this Court that on the advice of the elders, they had settled the dispute among themselves and all of them agreed that out of their own free will and volition, they entered a memorandum of compromise, which was reduced into writing.
In those circumstances, I.A.No.1 of 2020 is allowed as prayed for. Consequently, A.S.No.1236 of 2018 is disposed of in terms of the memorandum of compromise, which shall form part of the decree.
Miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
