THE HON'BLE SRI JUSTICE B. VIJAYSEN REDDY

                         F.C.A No.32 OF 2009

JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)

1.

Learned proxy counsel appearing for learned counsel for the appellant states that the arguing counsel has filed a Memo seeking withdrawal of vakalatnama. He states that even on the last date of hearing, despite learned counsel informing the appellant that he has been directed to appear virtually in the matter, he had not responded. In fact, he has not been cooperating with the learned counsel.

2. Memo is taken on record. Learned counsel for the appellant is discharged. The appellant is absent even today. It appears that he is not interested in prosecuting the appeal, which is accordingly dismissed in default and for non-prosecution along with the pending applications, if any.
