COMMON JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)
1. Mr. P.Vidya Sagar Reddy, learned counsel appears for the
respondent/husband.
2. The terms and conditions of settlement of the parties are not on record. Learned counsel for the parties state that there were some issues relating to the onetime payment for the marriage of the daughter of the parties in the future. While the appellant/wife has asked for an unspecified amount towards the marriage expenses of the daughter, learned counsel for the respondent states that his client is willing to pay a sum of Rs.5 lakhs.
3. After some back and forth, it has been agreed that the respondent/husband will pay a total sum of Rs.15 lakhs towards marriage of the daughter and the said amount shall be placed in an FDR to be handed over to the appellant/wife so that the money can fetch interest till the marriage of the daughter is solemnized. In lieu thereof, learned counsel for the appellant agrees that his client shall not press for the return of any jewellery etc., as has been claimed. In other words, the parties have agreed that besides a lump sum amount of Rs.25 lakhs that the respondent/husband has agreed to pay to the appellant/wife, he shall pay a sum of Rs.15 lakhs by way of a FDR drawn in favour of the minor daughter of the parties, in the care and F.C.A.Nos.44 & 46 of 2019 Page 1 of 2 2 custody of the appellant/wife, payable to the daughter on her attaining majority for meeting the expenses of her education and/or marriage etc., as may be deemed appropriate. In view of the above, the appellant/wife has given up all her other claims against the respondent/husband towards maintenance, past dues, return of dowry articles etc.
4. The parties shall file their respective affidavits reiterating the terms and conditions of the settlement recorded hereinabove within two weeks while exchanging copies with each other.
5. The present appeals are disposed along with the pending applications, if any.
