JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)

1.     The appellant/wife is aggrieved by the judgment dated

04.12.2020 passed by the learned Family Court allowing a petition

filed by the respondent/husband for divorce on the ground of cruelty.

2. The matter is listed for dismissal today, as none had appeared on behalf of the appellant on the last date of hearing. Today, Mr. T.P. Acharya, learned counsel for the appellant appears and tenders an apology for his absence on the last date. He assures this court that he shall be more careful in the future. After addressing lengthy arguments, learned counsel seeks leave to withdraw the present appeal while reserving the right of his client to continue pursuing the petition for maintenance filed by her before the learned Family Court.

3. Leave, as prayed for, is granted. The present appeal is dismissed as withdrawn along with the pending applications, if any.
