Item No.3
THE HON'BLE THE CHIEF JUSTICE HIMA KOHLI
AND
THE HON'BLE SRI JUSTICE B. VIJAYSEN REDDY
F.C.A.No.71 of 2016
JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)
1.
The matter is listed today in the category of 'for dismissal', as none had appeared on behalf of the appellant on the last date of hearing. However, today, Mr. C. Sumon, learned counsel for the appellant appears and tenders an apology for his absence on the last date. He assures this court that he shall be more careful in the future. He further states that the present appeal has been rendered infructuous, inasmuch as during its pendency, parties have been granted a divorce by mutual consent by the learned Family Court.
2. In view of the submission made hereinabove, the present appeal is disposed of as infructuous along with the pending applications, if any.
