JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)
1. The appellant is aggrieved by the judgment dated 08.03.2021
passed by a learned Single Judge dismissing a writ petition filed by
the writ petitioner for seeking directions to the official respondents
No.1, 3 and 4 to take action against the purported illegal construction raised by the respondent No.5 on land measuring Acs.4-04 Gts., in Sy.No.66/EE, situated at Vattinagulapally Village, Ranga Reddy District and for demolishing the existing illegal construction.
2. After addressing arguments at some length, Mr. Avinash Desai, learned counsel for the appellant/writ petitioner states that instead of pressing the present appeal, his client may be permitted to withdraw the same while reserving his right to approach the respondents No.3 and 4 with a grievance regarding the purported illegal construction raised by the respondent No.5 on the subject land.
3. The appeal is disposed of as not pressed along with the pending applications, if any, with liberty granted to the appellant as prayed for. It is, however, made clear that this court has not made any observations on the merits of such a grievance as may be raised by the appellant/writ petitioner before the respondents No.3 and 4. It shall W.A.No.189 of 2021 Page 1 of 2 be for the respondents No.3 and 4 to examine the representation of the appellant and decide the same in accordance with law.
