               WRIT PETITION NO.12916 OF 2021

ORDER:

This writ petition is filed, seeking to declare the order dated 29.04.2021 in LTR Appeal No.A4/LTR/411/2016, passed by the 3rd respondent in respect of the land admeasuring Ac.6.04 guntas in Sy.No.4/3, situated at Nandigam village, Talamadugu Mandal, Adilabad District as illegal and arbitrary.

It is the case of the petitioner that he is the absolute owner and possessor of the land admeasuring Ac.6.04 guntas in Sy.No.4/3, situated at Nandigam village, Talamadugu Mandal, Adilabad District. The petitioner got employment in Indian Army in 1971 and taking advantage of his absence in the village, one Kasalal Narsimhulu in collusion with Revenue official tampered the revenue records and cultivating the said land. The 3rd respondent has passed the impugned order dated 29.04.2021 in LTR Appeal No.A4/LTR/411/2016 without considering the petitioner's appeal and documentary evidence filed by him.

3. On 14.06.2021, this Court ordered for personal appearance of Sri Bhavesh Mishra respondent No.3. When the case is taken up today, the 3rd respondent Sri Bavesh Mishra personally present through virtual mode and 2 apologies for not passing a reasoned order in terms of the Judgment passed by this Court and undertakes that he would give opportunity to both sides and pass orders afresh in the light of the High Court orders.

4. In view of the said undertaking, the writ petition is allowed, setting aside the impugned order, directing the 3rd respondent to decide the matter in accordance with law as expeditiously as possible. No order as to costs. As a sequel, the miscellaneous petitions pending if any shall stand closed.
