CIVIL MISCELLANEOUS APPEAL No. 2198 of 2004
JUDGMENT:
A perusal of the proceeding sheet discloses that this matter was adjourned several times. However, on 03.06.2021, as there was no representation on behalf of the appellant, this Court directed the matter to be listed on 11.06.2021 under the caption 'For Dismissal'. Today, when the matter is taken up, there is no representation on behalf of the appellant. In the circumstances, it is presumed that the appellant is not interested in prosecuting this Civil Miscellaneous Appeal.
Learned Standing Counsel appearing for the respondent insurance company points out that there is no evidence produced by the appellant before the Court below.
Accordingly, this Civil Miscellaneous Appeal is dismissed for non-prosecution.
Miscellaneous Petitions, if any pending, shall stand dismissed. There shall be no order as to costs.
