JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)
1. After addressing arguments for some time in the present appeal,
learned counsel for the appellant seeks leave to withdraw the present
appeal as he states that the appellant/husband has already filed a
divorce petition against the respondent/wife in the Superior Court of
California, USA, wherein the respondent/wife is participating.
2. Mr. Parminder Singh Goindi, learned counsel appears along with the respondent/wife and clarifies that his client has taken steps to contest the aforesaid divorce petition filed by the appellant/husband in the concerned court at California, USA on the ground that the said court is not vested with jurisdiction to entertain the same. He states that the respondent/wife reserves her right to pursue the said objection before the concerned court and the anti-suit injunction proceedings initiated by her against the appellant/husband.
3. While granting liberty to the respondent/wife, as prayed for, the present appeal is disposed of as not pressed along with the pending applications, if any.
