JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)

1.      After addressing arguments at some length challenging an

interim order dated 20.04.2021 passed by the learned Special Court

for Trial and Disposal of Commercial Disputes, Hyderabad, directing

the appellant/tenant to pay 50% of the lease money to the respondent

towards running of a cinema hall and subject to the same, permitting it to operate the subject premises, learned counsel for the appellant seeks leave to withdraw the present appeal, while reserving the right of his client to pursue the petition filed under Section 9 of the Arbitration and Conciliation Act, 1996 (for short, 'the Act'), which is pending before the concerned court and contemporaneously to file a petition under Section 11 of the Act for approaching the court for appointment of an Arbitrator to arbitrate the disputes between the parties.

2. Leave, as prayed for, is granted. The present appeal is disposed of as not pressed along with the pending applications, if any.
