SA.MP.No. 321 of 2016 in/and SECOND APPEAL No. 664 of 1995 COMMON JUDGMENT:
On earlier occasion, when it was reported that the compromise was entered between the parties by way of filing SA.MP.No.321 of 2016 under Order XXIII Rule 3 CPC with a prayer to record the compromise in terms of memorandum of compromise and dispose of the appeal in terms thereof, the judgment in that regard was dictated, but, it was not signed on the ground that there were some clarifications required to be made at the instance of the parties. Thereafter, the matter came to be adjourned from time to time.
Today, when the matter is taken up, learned counsel for the parties submit that in the connected matter, S.A.No.157 of 1995, I.A.No.4 of 2021 is filed with a prayer to record the compromise between the parties and today, the said I.A. is allowed and the S.A. is disposed of in terms of the memorandum of compromise and therefore, they pray for closure of this Second Appeal.
In those circumstances, SA.MP.No.321 of 2016 and S.A.No.664 of 1995 are closed.
Miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
