WRIT PETITION No.19322 of 2020
ORDER:
Heard the learned counsel for the petitioners, the learned Government Pleader for GAD & Finance and Planning for respondent Nos.1 and 3, and the learned Government Pleader for Land Acquisition for respondent Nos.2 and 4. With their consent, the Writ Petition is disposed of at the stage of admission.
This writ petition is filed seeking to declare the action of respondent Nos.1 to 4 in withholding and not transferring the amounts as per cheques dated 10.08.2020 to the petitioners' Bank accounts, as illegal and arbitrary.
The learned Government Pleader for GAD & Finance and Planning, on instructions, has stated that out of the eight petitioners, the compensation amount was already paid to the four petitioners, i.e., petitioner Nos.1, 3, 4 and 6. But, insofar as petitioner Nos.2, 5, 7 and 8 are concerned, the cheques were returned, as there was a discrepancy with regard to their names, and therefore, the compensation amount could not be paid to them. The learned Government Pleader has further stated that the judgments and decrees passed by the Courts below in the O.Ps. and the Appeals filed by the petitioners show the correct names of the petitioners; that the proposals were already sent to the processing authority and that in case the petitioner Nos.2, 5, 7 and 8 file an appropriate 2 application before the concerned Senior Civil Judge, Narayanpet, the same will be considered and the amounts will deposited to the Bank accounts of petitioner Nos.2, 5, 7 and 8.
In view of the above made submissions, the writ petition is disposed of directing petitioner Nos.2, 5, 7 and 8 to file an appropriate application before the Senior Civil Judge, Narayanpet, within a period of one week from the date of receipt of a copy of this order. On such application being filed, the Senior Civil Judge, Narayanpet, shall consider the same and pass necessary orders thereon, duly correcting the names of petitioner Nos.2, 5, 7 and 8, as expeditiously as possible, preferably, within a period of four weeks thereof. The official respondents shall deposit the compensation amount to the Bank accounts of petitioner Nos.2, 5, 7 and 8, within a period of four weeks thereof.
The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
