ORDER: (Per the Hon'ble the Chief Justice Hima Kohli)
1. On the last date of hearing, in view of the submission made by
learned proxy counsel appearing for learned counsel for the petitioner
that the arguing counsel had since been appointed as a Government
Pleader and he may be permitted to obtain instructions from the
petitioner, the matter was adjourned to today.
2. Even today, the same lame excuse is being offered by the
petitioner. Quite apparently the petitioner is not interested in
prosecuting the present petition. However, in the interest of justice,
we have enquired from Mr. Sanjeev Kumar, learned Special
Government Pleader appearing for the respondents as to whether any
guidelines have been framed by the State of Telangana relating to unauthorised erection of statues on the pavements and roadsides contrary to the judgment dated 18.01.2013 rendered by the Supreme Court in SLP (C) No.8519 of 2006. The learned Special Government Pleader states that after the aforesaid judgment was rendered by the Supreme Court, the then unified State of Andhra Pradesh had issued G.O.Ms.No.18 dated 18.02.2013 prohibiting erection of statues on roadsides and in the middle of the road.
3. However, the ground reality is otherwise. From 2013 till date there are frequent occasions when the statues are being erected in the W.P.No.23368 of 2010 Page 1 of 2 middle of the road, on roadsides and other public places unregulated by any guidelines. Therefore, while deeming it appropriate to close the present writ petition, the Registry is directed to register a suo motu petition, entitled "In Re: Unauthorized erection of statues in the State of Telangana" and prepare a separate file.
4. The present petition is closed along with the pending applications, if any.
