JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)

1.     Learned counsel for the parties jointly state that the parties have

been able to negotiate a Memo of Compromise in writing whereunder,

both parties agreed that the impugned order be quashed and set aside

and they be permitted to approach the learned Family Court for

divorce by mutual consent.         It has also been agreed that the

appellant/husband shall pay a sum of Rs.26,00,000/- to the

respondent/wife as full and final settlement. Out of the said amount,

Rs.10,00,000/- has already been paid to the respondent/wife yesterday and the balance amount be paid when the divorce by mutual consent is granted by the learned Family Court.

2. In view of the aforesaid settlement, the present appeal is disposed of as not pressed along with the pending applications, if any. A copy of the Memorandum of Compromise shall be filed by the parties.
