WRIT PETITION No.15941 OF 2021
ORDER:
Sri S. Rama Mohan Rao, learned Assistant Government Pleader for Home, on instructions, would submit that the Police have already completed investigation and filed final report on 31.07.2020 treating the complaint as 'civil in nature' and a notice was also served on the petitioner on 30.07.2020 itself.
Sri Jai Bheem Rao, learned counsel for the petitioners would submit that there is a decree and judgment in favour of the 1st petitioner herein against Mahanandhi and two others restraining them from interfering with the possession of the 1st petitioner herein, over the subject property.
A perusal of the record would reveal that it is an ex-parte decree and the 1st petitioner has not submitted any representation to the 3rd respondent with a request to provide Police aid. Therefore, learned counsel for the petitioner sought liberty from this Court to submit representation to 3rd respondent with a specific request to provide Police aid by duly enclosing the said decree and judgment in O.S.No.173 of 2019 dated 04.01.2020, passed by the Principal Junior Civil Judge, at Gadwal. He sought further liberty to file a fresh writ petition, if 3rd respondent fails to consider the said representation and permission to withdraw the present writ petition. 2
Granting liberty as sought, this writ petition is dismissed as withdrawn. No costs.
As a sequel, miscellaneous petitions, if any, pending shall stand closed.
