COMMON JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)


1.     The present appeals arise from a common order dated

12.11.2019 passed by the learned Single Judge in three writ petitions.

W.A.No.111 of 2020 arises from W.P.No.15657 of 2019, and

W.A. No.119 of 2020 arises from W.P.No.15692 of 2019.

2.      By the impugned order, the writ petitions filed by the private

respondents assailing the decision of the appellant/Telangana State

Level Police Recruitment Board (TSLPRB) of deleting their names from the list of successful candidates as per the Recruitment Notification dated 31.05.2018, for the post of Sub-Inspector of Police on the ground that they had not acquired the qualification of graduation as on the cut off date i.e., on 01.07.2018, was allowed by holding that mere absence of the certificate in the possession of the private respondents would not be a ground to delete their names as long as they had acquired the required qualification within the stipulated timeline prescribed in the Notification. 3. Mr. M. V. Rama Rao, learned counsel for the appellant fairly states that on similar facts and circumstances as in the impugned judgment, a writ petition filed by an aggrieved candidate in respect of the very same Notification dated 31.05.2018, registered as W.P.No.13079 of 2019, was allowed by a learned Single Judge on 03.01.2020. Aggrieved thereby, the appellant had preferred an appeal, registered as W.A.No.97 of 2020, which was dismissed by a Division Bench vide judgment dated 07.02.2020. The said dismissal order was challenged by the appellant before the Supreme Court, registered as SLP (Civil) No.194 of 2021, that has been dismissed vide order dated 08.02.2021. In other words, the order of the learned Single Judge dated 03.01.2020, as upheld by the Division Bench vide judgment dated 07.02.2020, had attained finality.

As it is submitted that the present case is squarely covered by the captioned decision, following the judgment dated 07.02.2020, passed by the Division Bench in W.A.No.97 of 2020, the impugned order dated 12.11.2019 is upheld and the writ appeals are dismissed along with the pending applications, if any.
