This C.M.A is directed against judgment and decree passed in A.S.No.8 of 2001, dated 20-08-2002, on the file of the Court of the Senior Civil Judge, Gadwal, allowing the appeal and remanding O.S.No.49 of 1997, dated 13-06-2001, on the file of the Court of the Junior Civil Judge, Alampur to the Trial Court for fresh consideration on the ground that the Trial Court had failed to consider the evidence adduced properly.
Even though the matter has been posted today under the caption 'for dismissal', neither the appellant counsel nor the respondent counsel made a representation to attend before the Court.
Hence, the appeal is dismissed without costs.
