JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)
1. We may note that on 02.03.2021, the present appeal was
directed to be listed for dismissal on 15.03.2021. On 15.03.2021,
learned proxy counsel had appeared on behalf of learned counsel for
the appellant and stated that the arguing counsel was indisposed and
the parties were in the process of negotiating a settlement. As none
was present on behalf of the respondent, this court had directed
learned counsel for the appellant to give a written intimation of the next date of hearing to learned counsel for the respondent as also to the counsel appearing for the respondent before the learned Family Court, Secunderabad.
2. On the first call, as none was present on behalf of the appellant, the matter was passed over. By now, it is 04:30 P.M. Even on the second call, none is present on behalf of the appellant and the respondent.
F.C.A.No.544 of 2018 Page 1 of 23. It appears that the appellant is not interested in prosecuting the present appeal, which is accordingly dismissed in default and for non-prosecution along with the pending applications, if any.
