JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)

On the last date of hearing, learned counsel for the appellant was absent. As a result, the appeal was directed to be listed today in the category of dismissal. Today, learned counsel for the appellant states that the brief had been taken back from him by the appellant on 18.02.2010 itself and he has no instructions to appear in the matter any longer.
2. It appears that the appellant is not interested in prosecuting the present appeal, which is accordingly dismissed in default and for non- prosecution along with the pending applications, if any.
