CIVIL REVISION PETITION No.3174 of 2019
JUDGMENT :
This revision petition is filed challenging the order dated 05.10.2019 passed by the Sub-Divisional Magistrate & Special Assistant Agent to Government, Mobile Court at Bhadrachalam, in I.A.No.291 of 2016 in O.S.No.243 of 2016.
Heard learned counsel for the parties.
During the course of arguments, counsel for the parties have requested for remanding the matter to the Court below for passing reasoned order after hearing both the parties.
In view of the above submission, without going into merits of the matter, this revision is allowed, setting aside the impugned order. The matter is remanded to the Court below i.e. the Court of Sub-Divisional Magistrate & Special Assistant Agent to Government, Mobile Court, Bhadrachalam, for disposal of I.A.No.291 of 2016 in O.S.No.243 of 2016 afresh on merits by passing reasoned order within a period of 30 days from the date of receipt of a copy of this order, after affording opportunity to both the parties. The parties are directed to appear before the Court below on 25.01.2021. No order as to costs.
Consequently, pending miscellaneous applications, if any, shall stand closed.
