Writ Petition No.24613 OF 2019
ORDER:
1. Challenge in this Writ Petition is to declare the order of the 3rd respondent No.126/2019 dated 30.8.2019 refusing to register the sale deed dated 26.8.2019 in respect of Plot No72/A part admeasuring 150 Sq. Yards equivalent to 125.4 Sq. Meters out of 300 Sq. Yards in Sy.No.5/3 situated at Raidurg Panmaktha Village, Serilingampalli Mandal, Ranga Reddy District basing on the alleged notification dated 26.9.2013 issued by the 4th respondent.
2. This Court, while admitting the Writ Petition on 11.11.2019 granted an interim order in I.A.No.1 of 2019, which reads as under:
"For the reasons alike in the judgment of this Court dated 25.8.2014, the Joint Sub-Registrar-3rd respondent is directed to receive and register the document presented by the petitioner pertaining to Plot No.72/A part admeasuring 150 Square Yards equivalent to 125.4 Sq. Mts out of 300 Sq. Yards in Sy.No.5/3 situated at Raidurg Panmaktha Village, Serilingampalli Mandal, Ranga Reddy District, without reference to the District Gazette notification dated 26.9.2013 in accordance with the Indian Registration Act, 1908 and the Indian Stamp Act, 1899. However, it is open for the registering authority to refuse to register the deeds presented before him, if he has any other objection, by duly assigning reasons in support of such decision and communicate the decision to the petitioner. It is made clear that mere registration of deed does not confer title to the property and it is made clear that this order does not preclude the Government to take appropriate steps as warranted by law and to assert its title."2
3. In view of the positive direction given in the above interim order, this Court is of the opinion that no further orders need be passed in the present Writ Petition and the Writ Petition can be closed.
4. In the result, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any, shall also stand dismissed.
